AZ Sec. of State Katie Hobbs Lied To Arizona Voters By Design
“I am in full support of Maricopa County Board of Supervisor’s decision to oppose the drastic overreach of authority by the legislature. Using a fabricated crisis to rationalize an alarming abuse of power is unconscionable. If the assertion is not challenged it will set us down a dangerous path.” — Katie Hobbs
The fact that Katie Hobbs is in charge of Arizona’s elections while apparently having no Constitutional knowledge about the legislature’s role in those elections is beyond comprehension.
Katie, how about I introduce you to some justices of the United States Supreme Court who have laid out a precedent for us to follow. Let’s look at the Bush/Gore case from 2000:
“[e]ach State shall appoint, in such Manner as the Legislature thereof may direct,” electors for President and Vice President. Notice how it says the “legislature may direct.” Does it say Maricopa County? No.
In fact, they show you who the Constitution states shall appoint the electors:
“The individual citizen has no federal constitutional right to vote for electors for the President of the United States unless and until the state legislature chooses a statewide election as the means to implement its power to appoint members of the Electoral College.”
Again Katie, we see the legislature is who has the power to vote for electors unless they give that right to the voters of the state. Some time ago the Arizona legislature did give that right to the voters in the state.
However, we must look at why the legislature has the right to inspect elections in Maricopa County even after giving the right to appoint electors to the voters in the state.
“When the state legislature vests the right to vote for President in its people, the right to vote as the legislature has prescribed is fundamental; and one source of its fundamental nature lies in the equal weight accorded to each vote and the equal dignity owed to each voter. “
The “right” to vote as the “legislature has prescribed is fundamental.” Does it say Maricopa Co or the Secretary of State? No.
If Maricopa Co. isn’t abiding by the same rules that everyone else is, then we have a problem with that county violating the rights of equality of the other voters in Arizona.
But how can this violate the rights of other Arizona voters? Katie, they answered that question for us as well.
“[t]he idea that one group can be granted greater voting strength than another is hostile to the one man, one vote basis of our representative government.”
Therefore, if the legislature believes that Maricopa County did not process the election according to their intent then we have a constitutional problem as Justice Roberts pointed out.
“in a Presidential election the clearly expressed intent of the legislature must prevail.”
And why is that a constitutional problem?
“A significant departure from the legislative scheme for appointing Presidential electors presents a federal constitutional question.”
How could Maricopa County depart from the legislative scheme?
“The text of the election law itself, and not just its interpretation by the courts of the States, takes on independent significance.”
In other words, Katie, since the legislature is the only body authorized to appoint electors, then they are the only ones with AUTHORITY to judge the process by which Maricopa County processed their election. Your office does not have the constitutional authority nor does the governor or a court. ONLY the legislature.
The justices made this very clear by stating:
“In certifying election results, the votes eligible for inclusion in the certification are the votes meeting the properly established legal requirements.”
Why? Because if they do not meet the proper legal requirements set forth by the LEGISLATURE then they are not eligible to be counted. Ballots that violate the legislature’s wish are contrary to the CONSTITUTIONAL RIGHTS of the legislature.
Katie Hobbs, it is IMPOSSIBLE for the legislature to overreach their authority by demanding Maricopa Co turn over their election documentation. It appears that you are intentionally lying to the citizens of Arizona for personal and political gain, which is an abuse of power and worthy of impeachment.
